Andrew Kimble

Growing up, my dad would often tell me, in his Texas twang: “There never was a horse that couldn’t be rode; and there never was a cowboy who couldn’t be throwed.”

For those who don’t speak Texan, this saying meant, never underestimate yourself, but also, never underestimate your opponent. You can win any battle, no matter how long the odds, but you can also lose any battle, no matter how favorable your circumstances.

When I filed my first pizza delivery driver class action in 2014, I remember my friends questioning me over lunch. “You know Papa John’s probably has a lot of really good lawyers, right?”

This warning, of course, turned out to be true. Papa John’s does have really good lawyers. But, my response at lunch echoed what my dad taught me growing up. With a chuckle, I told them: “Never was a horse that couldn’t be rode.”

Twelve years and over $66 million won for pizza drivers later, I am so proud that our firm still embodies this saying. There is no opponent who strikes fear in our eyes. There is no fight that we do not think we can win. And we have the mentality, talent, and teamwork to justify our confidence.

But, now that we are an established force to be reckoned with, our firm doesn’t forget the second part of the saying, either. “Never was a cowboy who couldn’t be throwed.” We don’t rest on our laurels. We know our past successes do little for our current clients, let alone our future clients. We have to win their cases, too. So we approach every case and every issue with a beginner’s mind, making sure that we aren’t taking anything for granted. We are undoubtedly a great team, but we know that we can still be “throwed.” My dad would be proud.

Andrew Kimble and Andy Biller founded Biller & Kimble, LLC in 2019. Before that, Andrew started his career in New York City, bringing wage and hour cases on behalf of tipped restaurant workers. In New York, he helped thousands of servers, bartenders, and bussers win back the wages and tips that were taken from them. In the process, he came to appreciate the power of class and collective actions.

In 2014, Andrew moved home to Ohio so that he could help protect the rights of people in the community that raised him. He and Andy teamed up as co-counsel almost immediately, and eventually opened Biller & Kimble.

Over the years, they have won many victories, some more improbable than others. More memorable than the victories for him are the human connections he has made with his teammates and the workers they have represented. He gets a great sense of accomplishment and contentment from working together with good people to achieve their goal.

Andrew is a proud native of Dayton, Ohio. Outside of the office, he enjoys going on adventures big and small with his wife and two sons.

Approach

Andrew believes the strongest cases are built when the client’s interests stay at the center of every decision. He treats negotiations and litigation as if the client is in the room — even when that means turning down an easier fee in favor of a better result for the people the firm represents.
