What We Do

We fight for workers who were shorted on what they earned.

Most of our work is wage-and-hour litigation — unpaid wages, vehicle under-reimbursement, tip violations, and misclassification. We take the cases that require real expertise and real fight. As of August 24, 2026, Biller & Kimble has recovered more than $66 million firmwide.

Flagship Practice

Delivery Driver Claims

Vehicle under-reimbursement is our signature work. We have recovered millions for pizza and other delivery drivers whose employers failed to properly reimburse them for the cost of using their own cars. In Hatmaker, we successfully argued that employers must reimburse actual expenses or pay the IRS rate — the theory we won, not a nationwide safe harbor. Most still fall short.

Fighting Forced Arbitration

Employers use arbitration clauses to keep workers’ claims out of court. We have a strong track record of defeating motions to compel arbitration and keeping cases where they belong — in front of a judge.
